OVERVIEW Welcome as a user of the OTSO Sauna store! In these terms, “we” refers to OTSO Sauna. OTSO Sauna operates this store and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a curated shopping experience (“Services”). OTSO Sauna operates on Shopify’s technology, which enables us to offer the Services to you.

PART 3 – ORDERS When you place an order, you are offering to purchase the product or service. OTSO Sauna reserves the right to accept or reject your order for any reason at its sole discretion. Your order is not accepted until OTSO Sauna confirms acceptance. We must receive and process your payment before your order is accepted. Please check your order carefully before submitting it, as OTSO Sauna may not be able to accommodate cancellation requests after the order has been accepted. If we do not accept the order, if we make changes to it or if we cancel it, we will try to notify you by contacting you using the email address, billing address or telephone number you provided at the time of ordering. Purchases may be returned or exchanged only in accordance with our Return Policy [LINK]. You represent and warrant that your purchase is intended for your own personal or household use and not for commercial resale or export.

PART 4 – PRICES AND BILLING Prices, discounts and promotions may be changed without prior notice. The price charged for a product or service is the price in effect at the time the order is placed. The price is stated in the order confirmation email. Unless otherwise expressly stated, the prices shown do not include taxes, shipping costs, handling fees, customs duties or import duties. Prices shown in our online store may differ from prices in physical stores or in other third-party stores. We may from time to time run promotions for our Services that may affect pricing and may be subject to separate terms from these Terms. In the event of any conflict between the promotion terms and these Terms, the promotion terms shall prevail. PART 5 – SHIPMENTS AND DELIVERIES We are not responsible for delays in shipments and deliveries. All delivery times are estimates and cannot be guaranteed. We are not responsible for delays caused by the carrier’s actions, customs procedures or other events beyond our control. When we hand over the products to the carrier, ownership and risk of loss pass to you.

PART 6 – INTELLECTUAL PROPERTY RIGHTS The Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, videos and images and their design, selection and arrangement, are owned by OTSO Sauna, its affiliates or licensors and are protected by United States and other countries’ patent, copyright and intellectual property laws. These Terms grant you a licence to use the Services only for personal, non-commercial purposes. You may not reproduce, distribute, modify, publicly display, publicly perform, republish, download, store or transmit any of the Services’ materials, or create derivative works from them, without our prior written permission. Unless expressly stated otherwise herein, nothing in these Terms grants you any licence or other rights, nor shall it be construed as granting you any licence or rights, under any patent, trademark, copyright or other intellectual property right of OTSO Sauna, Shopify or any third party. Unauthorised use of the Services may violate state or national intellectual property laws. OTSO Sauna reserves all rights not expressly granted herein. The names, logos, product and service names, designs and slogans of the OTSO Sauna store are trademarks of OTSO Sauna or its affiliates or licensors. You may not use these trademarks unless OTSO Sauna has given you prior written permission. Shopify’s name, logo, product and service names, designs and slogans are Shopify’s trademarks. All other names, logos, product and service names, designs and slogans appearing in the Services are the trademarks of their respective owners.

PART 7 – OPTIONAL TOOLS As part of the Services, you may be given access to third-party tools provided by third parties that we do not monitor or control in any way. You acknowledge that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. However, in all purchases you make in our store, the other party is directly OTSO Sauna. You hereby expressly release Shopify and its affiliates from any claims, damages and liabilities arising from or relating to your purchases and payment transactions with the OTSO Sauna store.

PART 16 – LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW, OTSO SAUNA, OUR AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, SUBSIDIARIES, AGENTS, SUBCONTRACTORS, SERVICE PROVIDERS OR LICENSORS OR THE CORRESPONDING PARTIES OF SHOPIFY AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, CLAIMS OR DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST SAVINGS, LOST DATA, COMPENSATORY DAMAGES OR SIMILAR DAMAGES, WHETHER ARISING UNDER CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER THEORY, THAT RESULT FROM YOUR USE OF THE SERVICES OR PRODUCTS ACQUIRED THROUGH THE SERVICES OR FROM ANY OTHER CLAIMS RELATED TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING BUT NOT LIMITED TO ERRORS OR OMISSIONS IN ANY CONTENT OR ANY LOSS OR DAMAGE OF ANY KIND RESULTING FROM THE USE OF ANY SERVICES OR CONTENT (OR PRODUCT) PUBLISHED, TRANSMITTED OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.

PART 17 – INDEMNIFICATION You agree to indemnify, defend and hold harmless the OTSO Sauna store, Shopify and our subsidiaries, affiliates, officers, directors, employees, agents, subcontractors, licensors and service providers from and against any losses, damages, liabilities or claims, including reasonable legal fees, that arise from (1) your breach of these Terms of Use or any documents incorporated by reference, (2) your violation of any law or third-party right, or (3) your use of these Services. We will notify you of any indemnification claim provided that failure to give prompt notice does not relieve you of your obligations unless you suffer material prejudice.
